Luxridex ("we," "us," "our") operates a rideshare platform connecting passengers with drivers in the District of Columbia, Maryland, and Virginia (the "DMV Region"). This Privacy Policy explains how we collect, use, share, and protect your personal information when you use our website, mobile applications, and related services (the "Platform").
This Policy applies to all users — both passengers and drivers. Where a section applies only to one group, we say so clearly. By using the Platform, you agree to the practices described here.
2. Information We Collect
2.1 Information All Users Provide
- Account Information: Name, email address, phone number, password, and profile photo.
- Payment Information: Payment card details for passengers, bank account details for driver payouts. Card data is processed by our third-party payment processor; we do not store full card numbers.
- Communications: Messages with our support team, ratings, feedback, and complaints.
- Consent Records: Records of your acceptance of our Terms, this Policy, and any applicable authorizations.
2.2 Information Drivers Provide
- Eligibility Information: Date of birth, driver's license, government-issued ID, and where required, Social Security Number for tax and background check purposes.
- Vehicle Information: Make, model, year, license plate, registration, insurance documents, and vehicle photographs.
- Background Check Authorization: Consent to obtain driving record (MVR), criminal history, and identity verification.
2.3 Information Collected Automatically (All Users)
- Location Data: Precise GPS location, including pickup and drop-off points and route taken. For passengers, collected while the app is in use. For drivers, collected continuously while online in the app.
- Trip Data: Pickup and drop-off addresses, route, distance, duration, and fare.
- Device Information: Device type, operating system, unique device identifiers, IP address, and mobile network.
- Usage Data: App features used, pages viewed, crash reports, and performance data.
2.4 Information from Third Parties
- Background Check Providers: Driving record, criminal history, and identity verification for drivers, obtained with consent.
- Payment Processors: Payment confirmation and fraud signals.
- Mapping and Navigation Providers: Route and traffic data.
3. How We Use Your Information (All Users)
We use your personal information to:
- Provide the Platform, including matching passengers with drivers, calculating fares, processing payments, and enabling navigation.
- Ensure safety and security, including verifying identities, conducting background checks for drivers, detecting fraud, and responding to incidents.
- Communicate with you about trips, receipts, support requests, and service updates.
- Improve the Platform by analyzing usage, troubleshooting issues, and developing new features.
- Comply with legal obligations, including tax and regulatory requirements and responding to lawful requests.
- Operate AI phone support, where calls may be recorded and transcribed to improve service quality.
We do not sell your personal information.
4. How We Share Your Information (All Users)
We share personal information with:
- Drivers and Passengers: Limited information necessary to complete a trip, such as first name, pickup location, and vehicle details.
- Payment Processors: To process payments and prevent fraud.
- Background Check Providers: To screen drivers, with consent.
- Mapping and Navigation Providers: To calculate routes and provide traffic data.
- Cloud and Infrastructure Providers: For hosting, data storage, and analytics.
- Legal and Regulatory Authorities: When required by law, subpoena, or to protect safety.
- Successors: In connection with a merger, acquisition, or sale of assets.
We require service providers to protect your data and use it only for the purposes we specify.
5. Location Data (All Users)
We collect precise location data from all users. For passengers, location is collected while the app is in use to identify pickup and drop-off points. For drivers, location is collected continuously while online in the app to enable trip matching and navigation. You can control location permissions through your device settings. Disabling location may prevent you from using core Platform features.
6. Data Retention (All Users)
We retain personal information as follows:
- Account Information: Duration of account plus three years after deactivation.
- Trip Records: Seven years for tax and regulatory compliance.
- Location Data: Ninety days unless needed for a safety or legal investigation.
- Background Check Data (Drivers): Per FCRA requirements, typically five years.
- Support Communications: Three years.
- AI Call Recordings: Twelve months.
When an account is deactivated, trip records, payment records, and support communications are retained for the periods stated above. Account credentials and profile information are deleted or anonymized after the retention period ends.
7. Security (All Users)
We implement administrative, technical, and physical safeguards to protect your information, including encryption in transit and at rest, access controls, multi-factor authentication for administrative systems, regular security assessments, and employee training. No system is completely secure.
8. Data Breach Notification (All Users)
If we become aware of a security breach affecting your personal information, we will notify you and applicable regulators as required by law. Notification will be provided without unreasonable delay and will include, where known, the nature of the breach, the categories of information involved, and steps you can take to protect yourself. In the DMV Region, we will comply with the notification timelines and requirements of Maryland, Virginia, and the District of Columbia.
9. Children's Privacy (All Users)
The Platform is intended for users 18 years of age or older. We do not knowingly collect personal information from children under 18. If we learn we have collected such information, we will delete it.
10. Cookies and Analytics (All Users)
We use cookies and similar technologies on our website to remember your preferences, analyze site traffic and usage, and improve our services. You can control cookies through your browser settings. Disabling cookies may affect site functionality.
11. Do Not Track and Global Privacy Control (All Users)
Some browsers offer a "Do Not Track" (DNT) signal or Global Privacy Control (GPC). Our website does not currently respond to DNT signals. Where required by applicable law, we honor GPC signals as a valid request to opt out of the sale or sharing of personal information. Because we do not sell personal information, GPC signals do not change how we handle your data.
12. Automated Decision-Making (All Users)
We use automated systems to match passengers with drivers, calculate fares, and detect fraud. These systems use trip data, location data, and account information. We do not use automated decision-making to make legal or similarly significant decisions about passengers without human review. Drivers may be subject to automated deactivation decisions under our Driver Suspension and Deactivation Policy; drivers may request human review of such decisions by contacting support.
13. De-Identified and Aggregated Data (All Users)
We may create de-identified or aggregated data from personal information by removing characteristics that make the data personally identifiable. We may use and share de-identified or aggregated data for research, analytics, traffic pattern analysis, demand forecasting, and business purposes. We will not attempt to re-identify de-identified data.
14. Third-Party Links (All Users)
The Platform may contain links to third-party websites or services, such as payment portals, help centers, or social media pages. We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies before providing personal information.
15. Business Transfers (All Users)
If Luxridex is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, your personal information may be transferred as part of that transaction. We will notify you via email or in-app notice of any change in ownership or control of your personal information, and any choices you may have.
16. International Data Transfers (All Users)
Luxridex operates in the DMV Region. Some of our service providers may store or process data outside the United States. Where we transfer personal information internationally, we take steps to ensure it receives an adequate level of protection consistent with applicable law.
17. SMS and Text Message Communications (All Users)
By providing your phone number, you consent to receive SMS messages from Luxridex, including trip confirmations, driver arrival notifications, receipts, and account alerts. Message frequency varies based on your use of the Platform. Message and data rates may apply. You may opt out of non-essential messages by replying STOP to any message or updating your notification preferences in the app. Opting out of essential trip messages may limit your ability to use the Platform.
18. Push Notifications (All Users)
The app may send push notifications for trip updates, driver arrival, promotions, and account alerts. You can manage push notification preferences through your device settings or the app. Disabling push notifications may affect your ability to receive timely trip information.
19. Your Choices (All Users)
- Location: Manage through your device settings.
- Marketing Communications: Opt out via unsubscribe links or account settings.
- Account Information: Update through the app or by contacting support.
- Account Deletion: Request deletion by contacting privacy@luxride.com, subject to legal retention requirements.
20. Jurisdiction-Specific Rights (All Users)
- Virginia (VCDPA): Virginia residents have the right to access, correct, delete, and obtain a copy of personal data, and to opt out of targeted advertising, sale of personal data, or profiling. To exercise these rights, contact privacy@luxride.com.
- Maryland (MODPA): Maryland residents have similar rights to access, correct, delete, and obtain a copy of personal data. We will not discriminate against you for exercising these rights.
- Washington, DC: DC residents may have additional rights under the DC Consumer Protection Procedures Act. Contact privacy@luxride.com for requests.
We will verify your identity before fulfilling requests.
21. Additional Disclosures for Drivers
If you are a driver, we collect additional information as described in Sections 2.2 and 2.4, including your driving record, background check results, vehicle information, and tax identification. This information is used to verify eligibility, comply with legal requirements, and maintain safety on the Platform.
Background checks are conducted with your consent and in accordance with the Fair Credit Reporting Act (FCRA). You may request a copy of any background check report we obtain about you and dispute inaccurate information by contacting our support team.
Continuous location data is collected while you are online in the app. This data is used for trip matching, navigation, safety, and dispute resolution.
22. Data Protection Contact (All Users)
For privacy-related questions, requests, or complaints, contact our privacy team at privacy@luxride.com. We will respond within the time required by applicable law. If you are unsatisfied with our response, you may contact your state Attorney General's office.
23. Dispute Resolution (All Users)
Any dispute arising out of or relating to this Privacy Policy or our handling of your personal information is subject to the dispute resolution provisions in our Terms of Service, including any applicable arbitration clause and class action waiver.
24. Changes to This Policy (All Users)
We may update this Privacy Policy from time to time. Material changes will be communicated via email or in-app notice. Continued use of the Platform after changes constitutes acceptance.
